Než vůbec začneme o želvě uvažovat, je třeba vědět, že se jedná o ohroženého živočicha chráněného mezinárodní úmluvou Cites. Z toho vyplývají určité povinnosti.V podstatě každá suchozemská želva podléhá registraci. To znamená, že každá musí mít vystaven platný registrační list. Na některé z druhů želv (např. Testudo) se navíc vztahuje zákaz volného obchodu. U takových druhů je v případě prodeje potřeba mít ještě takzvanou " výjimku ze zákazu obchodní činnosti" . Jsou-li jsou doklady v pořádku, stačí nahlásit změnu majitele na příslušném úřadě a to do čtrnácti dnů od uskutečnění změny. Jde pouze o registrační povinnost za
kterou se nic neplatí a nadále nového majitele nijak nezatěžuje, pouze v případě úhynu je ohhlašovací povinnost stejná jako u změny majitele.
Skupina 1: želvy Testudo hermanni, Testudo marginata a Testudo graeca. Tyto druhy jsou zařazeny v příloze CITES II., ale EU je klasifikuje jako druhy zahrnuty v příloze A. Podle rozdělení jednotlivých kategorií v EU se tedy jedná o nejpřísněji chráněné druhy. Vzhledem k tomu potřebujete mimo registračního listu ještě tzv. výjimku ze zákazu prodeje, tj. další dokument formátu A4 ve žluté barvě. Ten je skoro stejný jako registrační list, ale mimo českého jazyka jsou všechny kolonky popsány také anglicky a nikdy se do tohoto dokumentu nevpisují změny, spojené s koupí, úhynem apod. Nezaměnitelné označení jedince je na této výjimce rovněž uvedeno. O výjimku ze zákazu prodeje se žádá zvlášt a prakticky nesouvisí s registračním listem. Znamená to, že ne každý jedinec, který má legální registrační list, dostane výjimku ze zákazu prodeje. V praxi to tedy vypadá tak, že můžete legálně vlastnit želvu s registračním listem, i když nemá výjimku ze zákazu prodeje, ale bez této výjimky ji nesmíte dále prodat ani nabízet k prodeji. Veškeré želvy, které jsou zahrnuty v příloze A nesmí být bez této výjimky nabízeny k prodeji ani prodány.
Skupina 2: Testudo (Agrionemys) horsfieldi. Jedná se o jediný druh, jenž zde popisujeme, který je zařazen v příloze CITES II., ale podle klasifikace EU spadá do přílohy B. Není tedy považován za tak přísně chráněný, jako druhy ostatní, a proto se v tomto případě nežádá o výjimku ze zákazu prodeje. K legálnímu vlastnictví želvy Vám tedy stačí registrační list.
Kromě registračních listů a výjimek ze zákazu prodeje je vždy dobré, abyste požádali prodejce nebo chovatele o doklad, spojený s koupí želvy, tj. o fakturu, paragon nebo o kupní smlouvu, na které bude uvedena i cena zvířete. Tento doklad můžete potřebovat, pokud se projeví nežádoucí problémy, např. zdravotní komplikace apod.
Bílý papír je Registrační list, ten musí mít všechny suchozemské želvy. Žlutý papír je výjimka z obchodní činnosti, takovou musí mít evropská Testuda a želvy zařazené do skupiny A. Zařazení jednotlivých druhů se občas mění, takže nemá smysl druhy jmenovat. U nás v ČR máme ochranu želv papírově zajištěnu možná nejdokonaleji v EU. Málokterý stát, pokud vůbec, vyžaduje a může si dovolit, chtít na jednu želvu hned dvoje papíry.
